In this employment tribunal claim form template example, the employee went off work with depression for a few weeks. When he returned, he was horrified to discover that the company had completely changed his commission structure. As a salesman, this impacted his take home pay. When he flagged this up, they denied that it was done deliberately, so ultimately he had to issue this claim for disability discrimination (for damages to injury to feelings) and also breach of contract / unlawful deduction of wages (for the commissions lost). Furthermore he felt he had no choice but to resign, so he claimed for constructive dismissal and for written statement of employment particulars (not issuing him a contract of employment) as well.
This template is presented so that you can download it and then adapt it for use in your own tribunal claim. The contents are taken from that section of the ET1 form called Details of Claim (aka particulars of claim). Most good lawyers – including us – always present these details on a separate page as they are so important, and in the form itself just write ‘see attached’.
